It's Time to Reassess?Our Homes | Rodel Foundation of Delaware

A recent push by the City of Rehoboth Beach to reassess properties in the sea-side community highlights a long-simmering problem with municipal finance in general and school finance in particular in Delaware: the burden of local property taxes is unequally spread from one property owner to the next. While Rehoboth Beach?s proposal would presumably only affect city taxes?and not school taxes?the proposal is another reminder of the urgent need for the General Assembly to mandate a state-wide property reassessment.

Roughly 31% of Delaware?s school funding comes from local property taxes?substantially less than the national average of 44%, but still an integral source of school funding. However, it is not how much, but how those taxes are levied that raises concerns. Properties in Sussex County have not been reassessed since 1974, when the median home price in the U.S. was less than $36,000. Properties in New Castle and Kent counties, meanwhile, have not been reassessed since 1983 and 1987, respectively.? Out-dated assessments create two, related inequities:

  1. Larger demographic and economic trends have caused different areas to experience vastly different rates of home price appreciation over the past several decades. It is unlikely that two homes that were assessed for the same amount in 1974 or 1983 would sell for equal amounts today. Thus, many home owners effectively overpay their proportionate share of property taxes, while many others underpay.
  2. Delaware?s Division III or ?equalization? school funding formula?intended to correct for disparities in the tax bases of different school districts?does not accurately reflect the current market value of properties. Thus, districts with small property tax bases three decades ago?but larger ones today?may continue to receive relatively more state funding than districts with the opposite problem.

In other words, outdated assessments create highly convoluted systems of tax winners and losers?whether at the individual home owner or school district level. This is unfair to both homeowners and Delaware?s schoolchildren.

While mass reassessments are administratively expensive?Rehoboth beach officials estimate $40 per property?the biggest resistance typically comes from homeowners, who fear having to pay higher property taxes after reassessment. However, this fear is typically overblown. Higher assessments can be married with lower tax rates, resulting in the same amount or only modest increases in tax collections. ?In fact, three years ago, a state task force recommended that any increase in property tax revenue incidental to a reassessment be capped at 7.5% initially and 5% as a result of subsequent reassessments.

Indeed, one of Delaware?s strategic advantages is its tax structure. A homeowner here pays a fraction?even pennies on the dollar?of what owners of comparable homes in Maryland, Pennsylvania or New Jersey pay. Coupled with the absence of a retail sales tax, Delaware is the ideal place to either raise a family or retire, and there is no reason for Delaware to lose this advantage.

Moreover, there is general agreement that properties need to be reassessed. A 2008 survey found that 71 percent of Delawareans ?strongly favor? (40 percent) or ?somewhat favor? (31 percent) a statewide reassessment of real property that would ?ensure that everyone is paying the right amount in taxes to fund public schools.?

But the present system creates a vicious cycle?inequities in what individual home owners pay in taxes results in no one wanting to pay taxes at all. And so long as tax burdens remain inequitable within school districts, there will always be resistance to communities banding together for the common good to finance critical school infrastructure needs or basic operating expenses, ultimately resulting in better school systems for our children and higher home values as well.

Woman wins small-claims suit over Honda hybrid mpg (AP)

LOS ANGELES ? A Southern California woman who challenged the legal status-quo by filing a small-claims action against Honda won her lawsuit Wednesday when a judge ruled that the automaker misled her about the potential fuel economy of her hybrid car.

Los Angeles Superior Court Commissioner Douglas Carnahan awarded Heather Peters $9,867 ? much more than the couple hundred dollars cash that a proposed class-action settlement is offering.

"At a bare minimum Honda was aware ... that by the time Peters bought her car there were problems with its living up to its advertised mileage," Carnahan wrote in the judgment.

Honda disagrees with the judgment rendered in the case and plans to appeal the decision, company spokesman Chris Martin said in a statement.

Peters, a former lawyer, said she is renewing her legal license after a 10-year lapse so she can represent other Honda owners who have the same problems she did.

"Wow! Fantastic. I am absolutely thrilled," she said when The Associated Press informed her of the judge's decision. "Sometimes big justice comes in small packages. This is a victory for Honda Civic owners everywhere."

Carnahan included in his 26-page decision a long list of misleading representations by Honda that he said Peters had correctly identified. Among them were that the car would use "amazingly little fuel," `'provides plenty of horsepower while still sipping fuel," and that it would "save plenty of money on fuel with up to 50 mpg during city driving."

"Actual performance of plaintiff's vehicle did not live up to these standards," he said. He noted that when she began receiving much less than the advertised mileage, "she knew she had a problem."

Peters opted out of the class-action lawsuit so she could try to claim a larger damage award for her 2006 Honda Civic's failure to deliver the 50 mpg that was promised.

The proposed class-action settlement would give aggrieved owners $100 to $200 each and a $1,000 credit toward the purchase of a new car. Legal fees in the class action would give trial lawyers $8.5 million, Peters said.

In small claims court, there are no attorneys' fees, cases are decided quickly, and individual payments are far greater.

Peters had hoped to inspire a flood of small-claims lawsuits by the other 200,000 people whose Honda Civic hybrids are covered by the proposed settlement. If all 200,000 owners sued and won in small claims court, she said, it could cost Honda Motor Co. $2 billion.

Peters launched a website, DontSettleWithHonda.org, and said she was contacted by hundreds of other car owners seeking guidance on filing small claims lawsuits if they opted out of the class-action case. But legal experts say it's unlikely that many owners would take the small-claims route because of the time and energy involved in pursuing such lawsuits.

Carnahan held two hearings on Peters' claim in January.

The commissioner noted that Honda had argued the way a car is driven might affect its gas mileage. He said that should have been explained in advertising and elsewhere.

A Honda technical expert testified that the company was required to post a sticker with the Environmental Protection Agency's estimate of the highest mileage the car could get. But Carnahan said in his ruling that "this does not seem to be the case."

"Honda's own testing should be the guideline for how it advertises its vehicles' mileages, not the generalized work ... done by the EPA," he said. "Can a Honda hybrid driven in careful and tested ways achieve 50 mpg? No doubt. Did it happen with Peters' car? No."

The ruling harshly criticized Honda on several points, including misrepresentations about a software update that was represented as a cure for the mileage problems. Peters said it just made the situation worse and she could no longer get more than 30 mpg in the car, which she still owns.

Carnahan found that Honda did commit fraud, but he could not find intentional fraud and thus did not award punitive damages. Most of the damages Peters was awarded were for extra money spent on fuel, both in the past and future, the cost of the car battery, and the decrease in the car's value because of its problems.

A judge in San Diego County is due to rule in March on whether to approve Honda's class-action settlement. Members of the class have until Feb. 11 to accept or decline the deal.

Small claims courts generally handle private disputes that do not involve large amounts of money. In many states, that means small debts, quarrels between tenants and landlords and contract disagreements.

The limit for small claims damages in California is $10,000. In other states it ranges from $2,500 to $15,000.

Filmmaker arrested during House hearing on shale gas (Reuters)

WASHINGTON (Reuters) ? The director of a documentary that portrays shale gas production as dangerous was arrested and escorted out of a Republican-dominated Congressional hearing on Wednesday, touching off a dispute over public access to the hearing.

Capitol Police handcuffed Josh Fox, director of the Oscar-nominated documentary Gasland, and led him out of a House science committee room after he refused to stop filming.

Republicans in charge of committee said Fox did not have credentials to tape the hearing, which was already being broadcast live on the Internet.

The hearing focused on an Environmental Protection Agency draft report that found an aquifer in Wyoming was likely polluted by fluids from hydraulic fracturing, the drilling technique that was the subject of Fox's controversial Gasland documentary.

Rep. Brad Miller, the top Democrat on the science subcommittee, objected to the decision to eject Fox. He said Republicans had also blocked an ABC News crew from filming the hearing because they did not request to film in advance.

"All those rules are to control access," said Miller, who made a motion that "all God's children" be allowed to film the hearing.

Miller's motion delayed the hearing for nearly 50 minutes until the required number of lawmakers were present to vote on the motion.

The Gasland documentary has gained notoriety for a scene with flaming tap water. Shale gas supporters have said it was filled with inaccuracies and distorts the safety record of U.S. shale gas production.

Shale gas output has skyrocketed in recent years thanks to advances in hydraulic fracturing, or fracking. While innovations have sharply boosted production of U.S. natural gas, critics say the rapidly expanding development threatens drinking water and public health.

Since the release of Gasland, Fox has become a high-profile opponent of fracking, joining efforts to prevent drilling in the Delaware River Basin and working to get water to families in Dimock, Pennsylvania, who say their water has been tainted by drilling.

When the House hearing resumed, Republicans, who strongly support the natural gas drilling, accused the EPA of basing its findings in Wyoming on politics and not science.

"In its single-minded pursuit of the hydraulic fracturing smoking gun, EPA appears to have lost focus on identifying the real causes and real solutions to drinking water quality problems in Pavillion, Wyoming," said Andy Harris, the top Republican on the subcommittee.

The EPA defended its work in Pavillion. EPA region 8 administrator Jim Martin stressed that its study was conducted under rigorous standards and the findings were limited to the unique geology in Pavillion and not meant to be applied to other places where drilling is occurring.

"EPA has acted carefully, thoughtfully, deliberately, and transparently in our ground water investigation and in sharing the data and findings contained in our draft report," Martin said.

ScienceDaily (Jan. 31, 2012) ? Internet users are increasingly asked to register with a user name and password before being able to access the content of many sites. In their upcoming Ergonomics in Design article, "A Passport to Password Best Practices," human factors/ergonomics researchers Soolmaz Moshfeghian and Young Sam Ryu identify impediments to efficient password creation and provide design strategies for enhancing the user experience.

Because there is no standard method for setting up passwords, each Web site employs its own set of requirements and restrictions. After investigating the pros and cons of design-related features of the requirement and restriction practices of 90 popular Web sites, the authors found that more than half the sites failed to display password guidance prior to the first attempt. Users may receive multiple error messages if their chosen passwords do not line up with system requirements, which can lead to confusion and frustration for the user and increased operating expenses for system administrators.

The authors offer a number of recommendations for Web designers seeking to improve the user experience: Provide users with password requirements prior to their first attempt; use clear and concise language to communicate the password requirements; present, at a minimum, length and character requirements; and avoid placing password requirements in the entry box. "This study helps us gain more insight into the current state of password practices and helps create more intuitive and empathic interactions," said Moshfeghian. "Intuitive password practices lead to increased user trust and thus user sustainability. In short, the optimal goal is to humanize interfaces, make them as intuitive as possible, and bridge the gap between users and interfaces."

Enhancing user experience through effective password practices can have many benefits. A more user-friendly registration process may produce a larger number of successfully registered accounts, which can translate into increased sales and a more recognizable brand. Fewer failed registration attempts can result in reduced system maintenance, security, and password recovery costs.
