Corrosion linked to 2011 Chevron refinery fire

SAN FRANCISCO (AP) ? Corrosion that went unchecked ? the suspected cause of a fire at Chevron Corp.'s Richmond refinery in August ? has been linked to a fire at the plant in October 2011, the San Francisco Chronicle reported Sunday (http://bit.ly/OzFQcu).

According to state inspection documents obtained by The Chronicle, a state Division of Occupational Safety and Health inspector who investigated the smaller 2011 fire documented allegations from two workers of corrosion at the refinery.

The 2011 fire took place during a scheduled maintenance shutdown and was quickly extinguished.

"We're afraid something is going to fall through the cracks," one worker told Cal/OSHA safety inspector Carla Fritz, who went to the plant to investigate the fire last November.

"We're concerned about increased corrosion ? we've increased temperatures and increased rates, and it takes a toll on the equipment," said the worker, who was identified in Fritz's notes as head operator of the lube oil plant ? the most senior of a 20-member operator crew.

Cal/OSHA said in a statement that a violation notice was not issued to Chevron over the 2011 fire "because the problem alleged and potential hazard had been already identified and corrected."

The Chronicle obtained Fritz's notes under the state Public Records Act. State officials redacted the names of Chevron employees she interviewed.

Chevron issued a statement in response to an Associated Press request for comment about the 2011 fire.

"Following an October 2011 incident at the Richmond refinery when we had a small fire contained in a furnace in the lubricants plant, Chevron took the appropriate actions to protect the safety of its employees and facilities," Chevron spokesman Sean Comey said in the statement.

"We immediately responded, shut down the affected operations, evacuated all non-essential staff, and successfully contained the incident," the statement said.

Another fire struck the refinery on Aug. 6, creating a huge plume of black smoke and sending thousands of people to hospitals with health complaints.

Chevron later said it was stepping up inspections after it was determined that the blaze was caused by a failure in a five-foot section of an old pipe.

Egypt probes military rulers for protest deaths

(AP) ? An Egyptian court official says authorities have launched a civilian investigation of the country's former military transitional rulers for their alleged role in the killing of protesters during their 18 months in power.

The official said Monday that an investigative judge was assigned to look into accusations against officers including the head of the ruling military council, Field Marshal Hussein Tantawi.

It would be the first time that Tantawi and other members of the Supreme Council of the Armed Forces are investigated for the deaths of protesters in clashes with security forces and soldiers. It is also unprecedented for civilians to probe officers, normally protected from oversight by anyone outside the military.

The official spoke on condition of anonymity because he was not authorized to speak to reporters.

Tibetan man sets himself on fire to protest China

BEIJING (AP) ? The grandfather of a revered Tibetan Buddhist figure died Saturday after setting himself on fire in protest of Chinese rule, the London-based rights group Free Tibet said.

The incident is the latest of dozens of self-immolations by Tibetans since 2009.

Free Tibet said 52-year-old Tamdrin Dorjee died at the scene near Tsoe Monastery in northwestern China's Gansu province.

It said the man is the grandfather of the 7th Gungthang Rinpoche, believed by Tibetan Buddhists to be the reincarnation of an important religious figure.

Dorjee's body was taken to his home village, Free Tibet said. Photos said to be from the scene show dozens of villagers and monks gathered around a body in smoke.

The self-proclaimed Tibetan government-in-exile confirmed the report. It said a heavy presence of paramilitary police in and around the monastery followed the self-immolation.

More than 50 Tibetans have self-immolated to protest China's rule of the Himalayan region, and most of them have died, according to tallies by Tibetan rights groups.

The government-in-exile has urged Tibetans not to give up their lives in self-immolation protests. Meanwhile, it tries to gain international support for their struggles against China's rule.

Calls to the government and police offices for Gannan Tibetan Autonomous Prefecture, where the self-immolation took place, rang unanswered Saturday evening.

China has blamed the Tibetans' exiled spiritual leader, the Dalai Lama, for inciting the immolations, but he denies the claim.

London: London?s Sunday Times said it may take legal action against cyclist Lance Armstrong, including pursuing him for alleged fraud over a libel settlement, in the wake of the United States Anti-Doping Agency?s report labelling him a drug cheat.

The newspaper, which is owned by Rupert Murdoch?s News Corp, is ?considering taking action to recover the money spent on a libel case he (Armstrong) brought and to pursue him for fraud,? said a Sunday Times spokeswoman.

Armstrong sued the Sunday Times and two of its journalists over an article that appeared in the newspaper in 2004 concerning the doping allegations. After a series of rulings in Armstrong?s favour in the UK courts, the two sides reached a settlement, the size of which was not disclosed. The newspaper also issued an apology to Armstrong.

One senior source at the newspaper said that the case cost it about $1 million.

There are precedents in the UK for the repayment of money won in libel suits. In one of the best-known instances, British novelist and former politician Jeffrey Archer paid back the damages he won in a libel case against the Daily Star newspaper. This followed his sentencing to four years jail in 2001 after being found guilty of perjury and perverting the course of justice in that libel case.

In August, Armstrong announced that he would no longer contest charges brought by the anti-doping agency, which earlier this week released a report and documentation, including affidavits from former Armstrong teammates, accusing him of not only using performance enhancing drugs but imposing a ?doping culture? on his team.

Mark Fabiani, a spokesman for Armstrong, said that he had no comment on the Sunday Times threat of legal action. Armstrong still emphatically denies doping, Fabiani said.

Fabiani rejected speculation that, in light of the anti-doping agency?s accusations, U.S. federal prosecutors might re-open a criminal investigation into a cycling team partly-owned by Armstrong, which was closed earlier this year.

A reopening of the case was ?entirely implausible,? Fabiani said. ?There is not a single thing in the USADA report that the US attorney did not have,? he said.
