iviTV Loses Legal Battle With TV Streaming Service

After an appeal was unsuccessful, iviTV have lost the right to stream live TV broadcasts signals via the internet.

The Seattle-based company, which launched in 2010 offered packages of television signal?s at super low price of just $4.99 a month.

The problem was that iviTV was not compensating the broadcaster?s for their content, and simply refused to pay the station owners.

In September of 2010 NBC, ABC, CBS and Fox all sued to block the company from airing their channels via online streams. The legal team for iviTV began arguing that a loophole in copyright law had existed, which allowed to cable operators to retransmit local signals. Then at the request of the big four networks and other broadcasting companies, an injunction against iviTV came about early last year.

?Continued live transmissions of copyrighted television programming over the Internet without consent would ? threaten to destabilize the entire industry,? an appellate court panel said. ?The public has a compelling interest in protecting copyright owners? marketable rights to their work and the economic incentive to continue creating television programming.?

Hal Bringman, a spokesman for iviTV believes that, ?This is not the final chapter of this story.?

The issue continues to be with streaming companies not compensating broadcaster?s for the content they are streaming to subscribers via computers and mobile devices.

Another company making the news is Aereo, based out of New York City and backed by Barry Diller, which is going through the same kind of legal process at the moment (albeit more successfully)?all in the name of compensation for provided programming.

In regards to the decision with iviTV the National Association of Broadcasters was thrilled with the news. ?We?re gratified by the court?s decision,? said Dennis Wharton, a spokesman for the group. ?This confirms that Congress never intended to allow Internet providers to retransmit broadcast programming without the consent of copyright owners.?
